Abacus Global Management, Inc. (NYSE: ABX) lodged a motion to file a second amended complaint in its defamation lawsuit against Coventry First LLC and Alan Buerger, Coventry’s co-founder and Executive Chairman.
Proposed amended complaint, filed in the U.S. District Court for the Middle District of Florida in Orlando, introduces four counts: defamation, defamation by implication, violation of Florida's Deceptive and Unfair Trade Practices Act, and defamation per se. The filing alleges nearly 20 false and misleading statements made by Coventry and Buerger regarding Abacus' business model and its use of third-party life expectancy data, including claims disseminated during public appearances and direct appeals to media outlets.
The amended complaint also cites a letter-writing campaign targeting state and federal regulators as part of the alleged defamatory conduct. According to the filing, Coventry purchased more than 4,000 life-expectancy reports from Lapetus between 2019 and 2022, exceeding Abacus’s own purchases during the same period.
