Kalshi, a U.S.-based prediction market operator, has contested a fine levied by Nevada's gaming regulator over alleged violations of state geofencing rules. The company argued in a filing that the penalty exceeded the regulator's authority and misapplied existing regulations.
The Nevada Gaming Control Board fined Kalshi $250,000 in late 2023, claiming the platform failed to properly restrict access to its services within state borders. Kalshi contends the fine was imposed without clear guidance on compliance and represents an improper expansion of the regulator's jurisdiction.
In its response, Kalshi stated that it had implemented geofencing measures in accordance with industry standards and that the fine was disproportionate to any alleged breach. The company also highlighted the broader implications of the regulator's actions, warning that such enforcement could stifle innovation in the prediction market sector.
The dispute underscores ongoing tensions between emerging financial platforms and traditional regulatory frameworks, particularly in states with stringent gaming laws. Kalshi's challenge may set a precedent for how similar platforms navigate compliance in regulated markets.
A hearing on the matter is scheduled for next month, where both parties will present their arguments before the regulator makes a final determination.
