A middle-management employee at Daimler Truck has been awarded €210,000 in back pay following a ruling by the Baden-Württemberg State Labor Court that found the company liable for gender-based pay discrimination.
The dispute centered on compensation for the years 2018 through 2022. The plaintiff, who worked in middle management, initially sought to match the salary of a male colleague serving as head of department. The court rejected her claim to that specific benchmark but determined that Daimler Truck failed to rebut the presumption of gender-related pay disparity.
Instead of the top earner’s salary, the court calculated the award based on the median compensation of male employees at the same hierarchical level. The ruling, issued by the Stuttgart-based court, concluded the proceedings and barred further appeals to the Federal Labor Court.
A Daimler Truck spokesperson stated the company maintained its position on pay equity throughout the case, noting the court’s confirmation that the plaintiff had no entitlement to the benchmark colleague’s salary. The company added that it does not engage in structural gender-based discrimination against tariff or non-tariff employees.
The case, docketed as 2 Sa 14/24, marks the end of legal proceedings on this matter.
