A federal jury in Delaware ruled on Friday that Parse Biosciences willfully infringed three patents held by Scale Biosciences, a unit of 10x Genomics, and awarded damages exceeding $4.8 million.
The patents in question—U.S. Patent Nos. 10,626,442, 10,982,256, and 11,512,341—were found valid and enforceable, with the jury rejecting Parse’s challenges to their validity. The patents are exclusively licensed to Scale Biosciences, originally stemming from Roche Sequencing Solutions.
The infringement period spans from February 2021 through June 30, 2026, covering Parse’s Evercode Whole Transcriptome product line. A 14% royalty rate was applied to the infringing sales during this timeframe.
10x Genomics, which acquired Scale Biosciences in 2025, plans to pursue additional remedies following the verdict. The company intends to seek enhanced damages and attorneys’ fees for the willful nature of the infringement, as well as a permanent injunction to halt further unauthorized use of the patents in the United States.
Parse Biosciences, a subsidiary of Qiagen, has not indicated whether it will appeal the decision. The case underscores the ongoing enforcement of patent rights in the biotechnology sector, particularly in areas involving genomic sequencing technologies.
Garry Nolan, co-founder of Scale Biosciences, stated that the verdict affirms the importance of protecting original scientific innovations. Randy Wu, general counsel of 10x Genomics, emphasized that companies cannot disregard patent rights and benefit from the work of others.
