A U.S. District Court jury in Delaware found that Parse Biosciences willfully infringed three patents exclusively licensed from Roche Sequencing Solutions. The jury also rejected Parse’s challenges to the patents’ validity, confirming all three as enforceable.
The court awarded 10x Genomics, which acquired Scale Biosciences in 2025, $4.8 million in damages. The award applies to sales of Parse’s Evercode Whole Transcriptome products from February 2021 through June 30, 2026, calculated at a 14% royalty rate on infringing revenue.
The patents at issue are U.S. Patent Nos. 10,626,442, 10,982,256, and 11,512,341. Parse Biosciences, a subsidiary of Qiagen, faces additional legal consequences as 10x Genomics intends to pursue enhanced damages, attorney fees, and a permanent injunction to halt further infringement in the United States.
Garry Nolan, co-founder of Scale Biosciences, stated that the verdict affirms the importance of protecting original ideas and strong patent rights in advancing scientific research. Randy Wu, General Counsel of 10x Genomics, said the ruling clarifies that companies cannot profit from others’ innovations while disregarding patent protections.
